Peter T. Henderson



Peter has represented large and small companies at every level of court in Ontario and in a wide variety of disputes.  He has extensive experience and expertise in partnership and shareholder disputes, injunctions, professional liability, negligence and franchise and real property-related litigation.  A number of his clients are large enterprises to which Peter has been counsel for nearly two decades. 

A number of cases in which Peter has appeared as counsel are reported in the official law reports.

Peter is recognized as an authority in the areas of electronic discovery (e-discovery) and technology for lawyers.  He is much sought-after as a speaker in these and other areas.  He has been an instructor in the Ontario Bar Admission Course and at Osgoode Hall Law School in Toronto.

Representative Cases

Represented the applicants in a proceeding under the Ontario Business Corporations Act for the wind up of a large transportation and logistics firm on the basis of oppression.  The applicants were awarded the value of their interest in the company and costs in excess of $220,000.

Represented a major franchisor on an application by a landlord to have a lease declared void ab initio on the basis that the commencement date of the term was indeterminate.  The Court dismissed the application.

Defended the largest event security company in Canada in an action for $272,000,000 in damages for conspiracy to injure, a claim made by a senior executive of another company in whose dismissal the client had participated.  The action was dismissed on a motion for summary judgment, with costs awarded to the client in excess of $89,000.

Represented a retired doctor in an action alleging that he was defrauded of nearly $2 million by a woman he met through an ad in the Toronto Star.  To date recovered in excess of $1 million.

Represented an event security company before the Alcohol and Gaming Commission of Ontario in proceedings by the Commission to revoke the client's license to provide security services in casino-related entertainment venues.

Represented the employer on an injunction to restrain a departing employee from using confidential information, soliciting clients of the employer and otherwise breaching duties owed to the employer.

Represented a large land developer in proceedings against a municipality to compel the municipality to give approval to a plan of subdivision and to comply with an agreement that the developer would not be required to pay certain development charges and levies.
