July 15, 2008 : Court grants summary judgment in wrongful dismissal case
The Superior Court granted summary judgment dismissing a claim for wrongful dismissal by an employee.  The employer's position was that it had not terminated the employment.  The employee, who was on long-term disability, represented to the insurer providing the benefits that it continued to be employed by the employer, which was a condition of receiving the benefits.  The court held that the receipt of the benefits on this basis was inconsistent with the allegation in the action that the employee had been terminated, and dismissed the action.
